PUBLIC NOTICE MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage executed on December 18, 2006 by Jeffrey Rusert and Nina N. Rusert, originally in favor of Taylor, Bean & Whitaker Mortgage Corp., and recorded in Instrument # 283203 on June 25, 2013, and rerecorded in RLPY Book 2007, Page 6030on 1/25/2007 in the Office of the Judge of Probate of Tallapoosa County, Alabama, and secured indebtedness having been transferred to U.S. Bank National Association, as trustee, on behalf of the holders of the Adjustable Rate Mortgage Trust 2007-3 Adjustable Rate Mortgage Backed Pass Through Certificates, Series 2007-3. Less and except the following described property: Part of Lot 85 of Windermere Subdivision Phase No. Two, as recorded in Plat Book 7 at Page 74, Elmore County, Alabama and being more particularly described as follows: As the Point of Beginning, start at a 3/4 inch iron pipe being accepted as the southeast corner of said Lot 85; thence run North 87 degrees, 08 minutes, 08 seconds, West and along the south line of said Lot 85 a distance of 260.80 feet to a 1/2 inch iron pipe on the meandering shoreline of Lake Martin; thence run a chord bearing of North 37 degrees, 49 minutes, 42 seconds, West and along said meandering shoreline of Lake Martin for a chord distance of 24.68 feet to a calculated point; thence run South 87 degrees, 18 minutes, 33 seconds, East 280.29 feet to a calculated point on the curving west right-of-way of Windy Point, said curve being a curve to the right, having a delta angle of 03 degrees, 14 minutes, 17 seconds, a radius of 351.38 feet and an arc length of 19.86 feet; thence run a chord bearing of South 12 degrees, 42 minutes, 05 seconds, West and along said curving west right-of-way for a chord distance of 19.86 feet to the Point of Beginning.
