The Alexander City Police Department arrested Jose Rolando Alman-Gonzales, 27, of New Orleans on Friday on one count of second-degree rape and two counts of sodomy.
Alexander City deputy police chief James Easterwood said investigators started looking into an incident of an adult having sex with a 12-year-old victim after receiving a call through dispatch.
“Her guardian noticed texts on the girl’s phone and contacted police,” Easterwood said. “The offender was identified during an investigation and arrest warrants were obtained.”
Easterwood said Alman-Gonzales and the girl became acquainted through text messages. Parents and guardians should keep a close check on their children’s electronic activities and make sure they are always in a safe environment, according to Easterwood.
“Parents and guardians should keep close tabs on their children’s activities,” Easterwood said. “They should closely monitor phone activity and social media apps.”
Easterwood said Alman-Gonzales was still being held in the Tallapoosa County Jail and U.S. Immigration and Customs Enforcement had a detainer on him.
Alabama law defines second-degree rape as a person 16 years or older engaging in sexual intercourse with a member of the opposite sex less than 16 and more than 12 years old provided, however, the offender is at least two years older than the other person. It defines sodomy as a person who is 16 years or older and engages in deviate sexual intercourse with another person less than 16 and more than 12 years old.
Both are Class B felonies and a conviction would result in a prison term of two to 20 years.
